Tool Name: 8020 WhatsApp Marketing Tool (the “Tool”)

This document outlines the Terms & Conditions governing the use of the WhatsApp Marketing Tool marketed by Eighty Twenty Design & Communication (“we,” “us,” “our”). We are a third-party marketing agency and do not own, operate, maintain, or support the tool. The tool is owned and operated by Lance Pilot Ltd (hereafter referred to as “Owner”). By accessing, signing up for, or using the tool, you (“you,” “user”) agree to these Terms & Conditions.

1. Role and Responsibilities

• Marketing Only: We are only marketing the Tool. We are not responsible for its functionality, updates, technical support, performance, or integration with third-party platforms like Meta.

• No Official Relationship with Meta or Owner: Neither we nor our employees, partners (official or unofficial), resellers, or affiliates are in any way officially associated with Meta or the Owner. Any references to WhatsApp or Meta are purely descriptive and do not imply endorsement or partnership.

• Optional Training: We may offer optional training as a goodwill gesture. This is not included in the service agreement.

• All responsibilities related to the tool—including but not limited to performance, uptime, data handling, pricing, compliance, and user satisfaction—are solely with the Owner.

• We do not have access to the tool’s source code, infrastructure, or backend systems.

2. Usage Terms

• By using this Tool, you agree to comply with all applicable laws, WhatsApp’s own business terms, and any changes introduced by the Owner, Operator or Meta.

• Misuse or abuse of the Tool may lead to permanent suspension without refund.

• We are not responsible for:
  • Downtime, bugs, glitches, or performance issues
  • Data loss, breaches, or unauthorized access
  • Pricing changes, feature removals, or service discontinuation
  • Compliance with local laws or platform policies
  • User dissatisfaction or business impact

3. Payment Terms

• We offer Yearly and Lifetime plans only.

• Pricing may change without prior notice. All payments are final and non-refundable.

• WhatsApp Cloud API fees (charged by Meta) are not included in our pricing.

• We may charge additional commission on the META fee.

4. No Warranty or Guarantee

• We do not guarantee uptime, results, deliverability, or business outcomes.

• The Tool is offered as-is, without warranties of any kind—express or implied—including but not limited to performance, security, reliability, or availability.

5. Limitation of Liability

• To the maximum extent permitted by law, our total liability shall not exceed INR 1000, regardless of cause or nature of the claim.

6. Indemnification

• You agree to indemnify and hold harmless Eighty Twenty Design & Communication and its associates from any claims, damages, or legal proceedings arising out of your use or misuse of the Tool.

7. Jurisdiction & Dispute Resolution

• These terms shall be governed by the laws of India, and legal jurisdiction shall rest solely with the Chennai High Court.

• Dispute resolution via arbitration or mediation shall occur only if mutually agreed by both parties.

8. Changes to Terms

• These terms may be updated at any time without prior notice.

• Continued use of the Tool after any changes constitutes your acceptance.

9. Acceptance

By completing any form, accessing, or using the tool, you acknowledge and agree to all the terms stated herein.

6. Cookies

7. Sale, Resale & White label Usage

• The tool is being sold or resold as a white labelled solution.

• We are not responsible for the use, resale, or redistribution of the tool by third parties or clients.

8. International Compliance

We make an effort to comply with GDPR, Indian IT Act, and relevant data privacy laws across the US, UK, EU, UAE, Qatar, and Australia to the best extent possible as a marketing entity. However, the primary responsibility lies with the Owner.
